Terms of Service

These Terms of Service ("Terms") govern your use of the website operated by Master's Employment Services ("Master's Employment", "we", "us" or "our") at mastersemployment.ca and your participation in our staffing services and work-related messaging program. By using this website, registering with our agency, or receiving our messages, you agree to these Terms. If you do not agree, please do not use the website or our services.

1. About our services

Master's Employment Services is a staffing agency based at 848 Markham Road, Scarborough, Ontario M1H 2Y2, providing temporary and permanent staffing to businesses across Ontario, Alberta, Quebec and British Columbia. Information on this website is provided for general information only and does not constitute an offer of employment, a guarantee of placement, or legal or professional advice.

2. Shift assignment messaging (SMS, RCS and WhatsApp)

If you register with our agency as a job seeker or worker and provide your mobile number, you consent to receive work-related messages from us by SMS text message, RCS (Rich Communication Services) and/or WhatsApp, including shift offers and assignments, schedule confirmations, changes and cancellations, reporting instructions, and related administrative notices.

  • Frequency. Message frequency varies depending on your availability and active assignments.
  • Cost. We do not charge for these messages, but message and data rates may apply from your mobile carrier. WhatsApp messages use your data plan or Wi-Fi.
  • Opt-out. Reply STOP to any SMS/RCS message, block or mute us on WhatsApp, or contact our office to stop receiving messages. Reply HELP or call 416-291-0611 for assistance.
  • Effect of opting out. Text messaging is our primary channel for time-sensitive shift offers. If you opt out, we will use telephone or email instead, and you acknowledge that shift offers may reach you more slowly or, in some cases, be filled by other workers before you can respond.
  • Accurate contact details. You are responsible for providing an accurate mobile number, keeping it current, and notifying us promptly if it changes or is reassigned.
  • Timeliness. Message delivery depends on carriers and third-party platforms beyond our control. We are not responsible for messages that are delayed, undelivered or misdirected due to carrier issues, device settings, an outdated number you provided, or platform outages. A shift is only confirmed once you receive confirmation from us.
  • Third-party platforms.Your use of WhatsApp is additionally subject to WhatsApp's (Meta Platforms') own terms and policies; your carrier's terms apply to SMS and RCS.

3. Registration and placements

Registering with our agency does not guarantee work, hours, or any particular assignment. Placements depend on client demand, your availability, qualifications and performance. Information you provide during registration must be accurate and complete, including your eligibility to work in Canada and any certifications you claim to hold. When on assignment, you agree to follow the reasonable workplace, health and safety rules of the client site as well as our policies.

4. Acceptable use of the website

You agree not to:

  • use the website for any unlawful purpose or in breach of these Terms;
  • submit false, misleading or fraudulent information through our forms;
  • attempt to gain unauthorized access to any portion of the website or its systems, or interfere with its operation;
  • scrape, copy or republish website content for commercial purposes without our written permission.

5. Intellectual property

The website and its content — including text, graphics, logos and the Master's Employment Services name and branding — are owned by or licensed to us and are protected by Canadian and international intellectual property laws. You may view and print content for personal, non-commercial use only.

6. Disclaimers

The website and messaging services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, about the website's availability, accuracy or fitness for a particular purpose. Nothing in these Terms limits rights or protections you have under the Ontario Employment Standards Act, 2000, the Occupational Health and Safety Act, or other applicable legislation that cannot be waived by contract.

7. Limitation of liability

To the maximum extent permitted by applicable law, Master's Employment Services and its directors, officers and employees will not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the website or the messaging program, including damages arising from delayed, undelivered or misdirected messages, missed shift offers, or reliance on website content. This limitation does not apply to liability that cannot be excluded under applicable law.

8. Indemnity

You agree to indemnify us against claims, losses and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the website, except to the extent caused by our own negligence or wilful misconduct.

9. Changes to these Terms

We may update these Terms from time to time. The current version will be posted on this page with its effective date, and your continued use of the website or messaging services after changes take effect constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute relating to these Terms, subject to any statutory rights you may have to bring proceedings elsewhere.
